1. About these terms
These Terms of Service ("Terms") are an agreement between you and Rydelinx LLC ("Rydelinx", "we", "us"). They apply to the Rydelinx rider app, the Rydelinx Driver app, our website and related services (together, the "Services"). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
We may update these Terms. If we make material changes, we will notify you in the app or by email before they take effect. Continuing to use the Services after the effective date means you accept the updated Terms.
2. Our service
Rydelinx operates a digital network that connects people who want rides ("Riders") with independent drivers who provide rides in their own vehicles ("Drivers"). Rydelinx operates as a transportation network company under the transportation network company laws of New Hampshire (RSA 376-A), Maine (29-A M.R.S. ch. 13, subch. 4, and 24-A M.R.S. ch. 93), Vermont (23 V.S.A. ch. 10) and Rhode Island (R.I. Gen. Laws ch. 39-14.2), and holds the permits those laws require.
Drivers are independent contractors, not employees or agents of Rydelinx. Rydelinx does not provide transportation services itself. Drivers decide when and whether to go online and which ride requests to accept.
The Services are currently available only for rides that start in New Hampshire, Maine, Vermont and Rhode Island.
3. Eligibility and accounts
- You must be at least 18 years old to create a rider account. Riders under 18 may not ride unless accompanied by an adult account holder.
- You sign in with a mobile phone number and a one-time text code. You are responsible for keeping access to your phone and account secure and for all activity on your account.
- You agree to give accurate information and keep it up to date. You may not create an account for someone else, share your account, or create more than one rider account.
- By giving us your phone number, you agree that Rydelinx and its service providers may send you text messages about your account and rides, including sign-in codes. Message and data rates may apply. You can opt out of non-essential messages at any time by replying STOP.
4. Booking rides
- Before you confirm a ride, the app shows your pickup and drop-off, estimated distance, trip time, arrival time and an upfront price for each available ride type (Economy, Comfort, XL and Premium).
- Ride types have different vehicle and capacity standards. Do not book a ride type with more passengers than it allows (4 for Economy, Comfort and Premium; up to 6 for XL).
- A request is not guaranteed to be accepted. If no Driver accepts, you will not be charged.
- Make sure your pickup location is accurate and safe and that you are ready when your Driver arrives.
5. Prices and payment
Upfront price
The price shown when you book includes the ride fare, any Rydelinx booking fee, any reservation fee for scheduled rides, tolls and applicable airport or government fees. We will charge the upfront price unless:
- you change the destination or add a stop during the trip,
- the trip changes significantly because of your request or conduct (for example a much longer route you ask for, or extended waiting you cause), or
- a cleaning or damage fee applies under Section 8.
If the price changes for one of these reasons, the app will show the updated price.
Payment methods
- Card: Visa, Mastercard, American Express or Discover. Card rides are charged automatically after the trip. Card payments are processed by Stripe, Inc.; Rydelinx never stores your full card number.
- Cash: where you choose cash, you pay the Driver the amount shown in the app at the end of the trip. Please carry exact change where possible.
You authorize us to charge your selected payment method for rides, fees and any amounts owed under these Terms. If a charge fails, we may try again or use another card on your account.
Tips
Tips are optional. 100% of any tip you give goes to your Driver.
Receipts and disputes
A receipt for each ride is available in your ride history. If you think a charge is wrong, contact us through Help and Support within 30 days of the ride.
6. Cancellations and fees
- You may cancel a ride request at any time. If you cancel after a Driver has accepted and a cancellation fee applies, the app will tell you the amount before you confirm the cancellation.
- If you are not at the pickup location within the waiting period shown in the app, the Driver may cancel and a no-show fee may apply.
- Cancellation and no-show fees compensate Drivers for their time and are shown in the app. The amount is always shown in the app before it is charged.
7. Airport and scheduled rides
- When you select an airline, we use it to direct your Driver to the departures door nearest that airline's check-in. Airlines sometimes move their counters; please tell your Driver if yours has changed.
- Airport pickups must follow each airport's rules and designated rideshare pickup areas.
- You can view, edit or cancel scheduled rides in the app. A scheduled ride is a request reserved by a Driver; Rydelinx will make reasonable efforts to provide it but cannot guarantee that a Driver will be available. If your reserved Driver cancels, we will try to find another Driver and notify you.
8. Rider conduct
To keep rides safe and respectful, you agree that you will not:
- harass, threaten, discriminate against or act violently toward a Driver or anyone else;
- ask a Driver to break traffic or other laws, or carry illegal items;
- bring open containers of alcohol, use drugs, smoke or vape in a vehicle;
- damage a vehicle or make it dirty beyond normal use;
- bring more passengers than the ride type allows; or
- misuse the Services, including fraud, false safety reports or reverse-engineering the apps.
Service animals are always welcome. If you damage or soil a vehicle, we may charge you a reasonable cleaning or damage fee, supported by photos, which we pass on to the Driver.
Zero tolerance. Drivers may not use drugs or alcohol while using the Services. If you believe your Driver is impaired, end the ride as soon as it is safe, and report it immediately in the app or through the Safety Center.
9. Safety features
The Safety Center lets you send an SOS, call 911 and share your live location, alert your emergency contacts, share your trip status and report a safety issue. These tools help but do not replace emergency services. In an emergency, always call 911. Rydelinx does not monitor every trip in real time and cannot guarantee a response time.
All Drivers must pass a background check, hold a valid license, registration and insurance, and have their vehicle approved before driving on Rydelinx, and must keep these documents current.
10. Terms for drivers
Drivers must also accept the Rydelinx Driver Agreement, which governs their relationship with Rydelinx in more detail. In summary:
- Earnings. Drivers keep 90% of each ride fare and 100% of tolls and tips. Rydelinx keeps a 10% service fee on the fare plus any booking and reservation fees paid by Riders.
- Payouts. Drivers receive payouts through Stripe after connecting a bank account and can withdraw their available balance at any time. On cash rides, the Driver collects the full amount from the Rider; the Rydelinx share for that ride is deducted from the Driver's card earnings balance.
- Requirements. Drivers must be at least 25 years old, hold a valid driver's license, pass the required criminal background and driving record checks, and keep their vehicle registration, inspection and auto insurance valid. Vehicles must meet the standards for each ride type.
- Independent contractors. Drivers choose when to drive, which requests to accept and which scheduled rides to reserve. Drivers are responsible for their own taxes and vehicle expenses.
- Conduct. Drivers must obey traffic laws and Rydelinx's zero-tolerance drug and alcohol policy, may not discriminate, and must accommodate service animals.
11. Insurance
Rydelinx does not provide auto insurance. Each Driver is responsible for maintaining their own automobile insurance that covers rideshare driving and meets the requirements of each state where they drive, for the entire time they are logged in to the app and on a trip. Drivers must upload proof of insurance before accepting rides and keep it current; Rydelinx may deactivate a Driver whose insurance lapses. Riders and Drivers should report any accident or injury through the app and to the Driver's insurer.
12. Ratings and content
Riders and Drivers can rate each other and leave comments. Ratings help keep the community safe and may affect access to the Services. Do not post content that is false, offensive, discriminatory or that reveals someone's personal information. You give Rydelinx a non-exclusive, royalty-free license to use content you submit (such as ratings, comments and support messages) to operate and improve the Services.
13. Our intellectual property
The Services, including the apps, website, software, designs, the Rydelinx name and logo, are owned by Rydelinx and protected by law. We give you a limited, personal, non-transferable, revocable license to use the apps for their intended purpose. You may not copy, modify, distribute, sell or reverse-engineer the Services, or use our name or logo without permission.
14. Suspension and termination
You may delete your account at any time in the app or by contacting us. We may suspend or end your access to the Services if you break these Terms, if required by law or a regulator, or to protect the safety of our community. Where appropriate and lawful, we will tell you why and give you a way to respond. Amounts you owe for completed rides remain due after termination.
15. Disclaimers
Except as required by law, the Services are provided "as is" and "as available." Rydelinx does not guarantee that the Services will be uninterrupted or error-free, that a ride will always be available, or the conduct of any Rider or Driver. To the fullest extent the law allows, Rydelinx disclaims all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
16. Limitation of liability
To the fullest extent the law allows, Rydelinx will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Rydelinx's total liability for any claim relating to the Services is limited to the greater of the amounts you paid Rydelinx in the 12 months before the claim or $100.
Nothing in these Terms limits liability that cannot be limited by law, including liability for gross negligence, willful misconduct or personal injury where such limits are not allowed, or any rights you have under the consumer protection laws of your state.
17. Disputes and arbitration
Please read this section carefully; it affects your legal rights.
- Talk to us first. Before starting a formal claim, contact us at info@rydelinx.com and give us 30 days to try to resolve it informally.
- Individual arbitration. If we cannot resolve it, you and Rydelinx agree to resolve disputes through binding individual arbitration administered by the American Arbitration Association (AAA) under its consumer rules, rather than in court. Either party may instead bring an individual claim in small claims court.
- No class actions. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class or representative proceeding.
- Opt out. You may opt out of this arbitration agreement by emailing info@rydelinx.com within 30 days of first accepting these Terms, with your name, phone number and a statement that you opt out.
- Exceptions. Either party may seek injunctive relief in court for misuse of intellectual property, and claims that by law cannot be arbitrated are excluded.
18. General terms
- Governing law. These Terms are governed by the laws of the State of New Hampshire and applicable federal law, including the Federal Arbitration Act, without regard to conflict-of-law rules.
- Entire agreement. These Terms, the Privacy Policy and (for Drivers) the Driver Agreement are the entire agreement between you and Rydelinx about the Services.
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
- Assignment. You may not transfer these Terms. We may transfer them in connection with a merger, acquisition or sale of assets.
- No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
